Consentual sex of a minor?
Will someone be prosecuted for having sex wtih a minor if it was consensual for both of them? What would most likely happen to an individual if they just turned 18 and the girl was 15? What if the girl had asked, and the only reason they are in trouble is because her parents found out, the girl doesn't want to press charges but her parents do, What will happen. Please no suggestions, just facts if you know them. Thanks.

I know this guy, my husband works with him actually. He's 20 and he was seeing this girl who was 17, same kinda deal. He's now on familywatchdog.com and a registered sex offender in my area.

You can be charged with rape, and if you just turned 18, you will be tried as an adult.
The Law is the Law and regardles of your girlfriend consenting, she is still considered a minor and you an adult.

yes u will. consentual or not the boy usually gets in truble 4 it. even if the boy and the gurl were both under 18 the guy would still most likely get in truble. it seems unfair but thats the way it is. and the gurls parents r the 1 pressing charges and the gurl gets no say. no matter wat she says the guy who just turned 18 STILL had sex with a minor and that against the law. its a fact. so if ur over 18 and r gona have sex with a minor make sure NO1 who mite snitch knos. im not sure wat the penalty is but it wont b very bad. its not stachitory cuz she wanted 2. but i can guarentee theres gona b sum kinda punishment
Yes! Whoever it was could be prosecuted! The main point isn't the fact that it was consensual (because of which the individual will not have as hefty a sentance), but she was still under age. The guy and girl should both go to jail: the guy for going along with it and the girl asking for it. Kids are growing up too fast these days. You'll be sorry when you're pregnant with three kids before you're 18 and no future.
What will happen we be the 18 year old will be arrested, and the 15 year old will look like an idiot. Because he or she knew better. Why would a 18 year old want a 15 year old anyway? Even if it was just sex, the 18 year old would look desperate because he or she cant find somebody their own age. People are crazy these days.
the fact is, what you did was illegal. no two ways about it. she could yell yes until the cows came home, but she can't change the fact she's 15. a MINOR. that means she's too young to make decisions on her own. so her parents do. good luck, but it doesn't look good for you.
I don't think there are any states that allow 15-yr-olds to consent to sex with someone over 18. Her parents CAN report it as a crime, and the police will investigate, and may decide to press charges if there is enough evidence to prosecute.
Actually, in Indiana(heard it on the news today) a 14 year old can have consentual, up to a 4 year differences in age. Perfectly legal. It varies by state, but that is the new deal for Indiana.
Yes her parents could press charges and if they do and win you could forever be named a sexual preditor. In some states 16 is legal. Some states 17 or 18. Look online about the laws of your state.
If you met her and had sex with her before you turned18 your chances of being in trouble are less. But you will go to jail my friend, it happened to a good friend of mine a couple years out of high school. He got ten years all for one night of fun with a hot 16 year old that looked 20.
it really depends on the law of your state. to me its wrong for the parents to press charges on her behalf if it was consensual as she is as responsible as you are.
right now in georgia there is a guy who was 17 and had sex with a 15 yr old, supposedly it was consensual and he has been in jail for 3 yrs for it. it has been in the news of late but there is a lot of debate on whether or not it was consensual as he and his buddies taped the whole thing and the girl sure didn't look like she was into it, in fact if you saw the tape (which i did) it's rape, no question about it but that being said the jury found him not guilty of rape for some reason. if i were you i would check my state's laws concerning minimum age and consensual sex. just do a websearch for your state.gov and there should be a search on the website and type in your search terms. better to be safe than sorry. oh, too indiana just passed a law today that says the age of consent is 14 with a 4 yr difference.
There is no such thing as consent if you are below the age of consent.
The circumstance you outline here the 18yo is guilty of statutory rape if he knew or should have suspected the girl was 15.

Depending on the circumstances, and the difference in the age, sometimes it may amount to nothing. If the ages are very close (say 16 1/2 and 18) they probably won't do anything major. 15 and 18, though...that's when it starts getting tricky, because you're probably dealing with a high school graduate, and someone who hasn't even been to prom yet (most likely...just using that as an example to illustrate the example.)
However, just because the girl 'consented' won't mean anything. Sure, it does mean that you wouldn't have aggrivated assault thrown on top of the statutory rape, but the idea is that the 15-year-old girl isn't mature enough to be mentally capable of knowing the reprecussions of sex, and therefore, their judgment can't be trusted...same reason most contracts won't involve anyone under 18. In most (if not all) a 16-year-old's signature isn't a legally binding signiture.
Since the girl isn't 18, her guardians will be the ones to decide about pressing charges, not the girl. They will let her press them without her parents, but they won't let her say no.

For the record it is called statuatory rape because the state is pressing the charges, parents have nothing to do with it. State laws are called statutes, local laws are ordinances, so on. This is not the law, but speaking about similar cases there is roughly a 3 year allowance. And the age of consent in most states is 16, some 18, and missouri and I think south carolina are 14. If it was you, or someone you know - hire a lawyer like now, there are mandatory sentencing guidelines in some cases so whoever this is could be looking at a long life of tax payer subsidized meals. And stop talking about it, don't think this stupid FreeLawAnswer.coms thing couldn't end up in court.
It would not matter if the 15 year old was begging for it and if her parents approved, too. that 18 year old would be doing jail time. It's still rape in the eyes of the law.

Having sex as an adult with a minor under any circumstances is a sex crime. A 15 year old cannot have 'consensual' sex, they are the wards of their parents, guardians or the state. You can go to prison for this, they do hate pedophiles there, so it will be a horrible stay for the convict, and you will have to list yourself publicly as a pedophile when you are released. This is no different than child pornography, child abuse or rape. In fact the crime is called in every state, 'Statutory Rape.'
Depends where you live. If the parents prosecute, the 18 year old will get in trouble. And the punishment is a lot harsher now. The most common I see is at least 6 months for taking liberties with a minor - one offense. You'll need to look up the law in your state though because it varies.
The charges will be filed because she is young and still a child in the eyes of the law. Parents get the finial say in that situtions. Some guys actually have her and her parents sign a paper saying they know that they are having sex..so that if the relationship ends she can't say that she was having sex or raped.. that type of thing.
