Connecticut resident attacked by a Native American on the Mashantucket Reservation, where will trial be held?


This was a simple case of battery so it cannot run to federal court under the Major Crimes Act. thanks richard

If the defendant or the tribe chooses they can assert tribal jurisdiction and have the case hear in tribal court. Richard
there wont be a trial
non tribal members can not be tried within a tribal court even if the crime occurred on the reservation. this is why so many times, non natives get away beside rape and murder etc on the rez. rarely does federal court even try them. we shall see what happens in this skin.
If the reservation is Federally recognized, the trial will go to the federal court. Tribal courts solitary deal with tribal members. Tribal courts own no jurisdiction in cases involving non-tribal members. .
