a lawyer sue the uninsured driver plus the insurance company,or are you only allowed to collect from one.my lawqyer is sueing both my uninsured plus the defendent.i dont quit understand this approach

In most states, yes. When you are injured, the individual who hit you is responsible for the damages they cause. Most people don't have huge checkbooks but they do hopefully hold insurance. If their insurance coverage is not enough to cover your damages, than your uninsured/ underinsured motorists coverage picks up where their coverage ends. For instance, if you have $100,000 worth of damages, and the fellow who hit you have $25,000 of insurance, you could get $25,000 from his insurance carrier and then gain the rest (up to your policy limits ) from your insurance company under your UM coverage. I practice in Florida and that it the statute here and I think it's the same in most other states save for perhaps Louisiana. (Their laws are very different near.) Hope that helps.
