Filing Small claims for BOA?

Last Friday, I deposited my paycheck, cash, into my BOA account at 3:45pm. I went and purchased a few items at the grocery store, As usual on my way home. On Monday, I find a few over draft charges on my account. This month I just purchased and moved into a new home and sold my old one. So, an explanation is not necessary about where one finds time to be short once and a while. I am sure one understands. I have deposited cash into my account between 3:30pm to 3:45 pm regularly for some time now. I have always got home and saw the balance on the web interface as greater the deposited amount, but this time, some extra fees. So, I called to find out the problem. The agent told me the deposit was made after 4:00pm. I said I have a receipt that says 3:45pm. 'Oh, he says'.. I am put on hold, nothing he can do he says, I want to talk with a supervisor, the superviser says that, the first agent was mistaken, 3:00pm is the 'cut off' .. Continued...


Answer:
You need to file in the County where the deposit was made.

This way - businesses seem to be cut some slack as they pay taxes in that County and bring in taxes as well for the county - that is where the breaks for the business should be granted by the courts they support.

You should be able to find any cut off times in the terms and conditions of your account.

If you have a receipt I would ask to speak to the bank manager and ask what has changed for your account.

File at your local court, they can tell you if you need to file in another area .
