If you are considered PT with an employer but work FT hours 38+ a week, do they have to make you FT at all?

I live in Colorado Springs, CO and was told by several people that if you work several consecutive weeks at 38+ hours a week consequently they have to offer you full time.
That is highly specific to the company themselves. Just as an example, UPS have a policy that says 90 days and a person has to be offered a binding position. They will work a person 89 days, lay them off for one and start them over again.

Check with your HR folks and find out how many weeks of over 38 hours is considered before offering full time status.
