IVF - birth certificate query?
If you have a child by IVF and the sperm used is from a donor that you dont know,, whose name goes on the birth certificate as the father? If you're a married couple and the male is not the biological father, does it register the father as being the husband in the couple? If so, why?
The law says that the the birth certiicate doesnt need a father named on it.
Your husband can be named as the father and he has the same rights and responsabilities as if he was the biologiacl father.
yes the (the husband) would be named as the father
Answer:
When a child is born within wedlock, the husband is deemed by law to be the father, unless cogent evidence is produced to the contrary. Where a couple has decided to go ahead and use IVF for the wife to bear a child to the husband, then there can be no objection to the husband entering his name as the child's father. He is, after all, undertaking parental responsibility for that child and that child is a child of the family.
I don't think it matters that he is not the 'biological' father
my birth certificate has my step-fathers name as my father, probably cos my mum was too embarrassed to write Dr Hilary Jones :-) lol
