Which amendment states that you have the right not to talk or something?
The 5th....
That would be the Fifth Amendment.
But don't count on any law enforcement agency to remind you of that fact.
It is the Fifth Amendment. 'No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentation or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or Public danger; nor shall any person be subject for the same offense to be twice put in jepardy of life or limb; nor shall BE COMPELLED in any CRIMINAL case TO BE A WITNESS AGAINST HIMSELF, nor be DEPRIVED of life, liberty or Property, without DUE PROCESS of law; Nor shall private property be taken FOR PUBLIC use (Imminent Domain), without just compensation...' Compare that to the Ten Planks of communism!
The 5th amendment gives you the right not to answer on the grounds that it could incriminate you,
Answer:
The First Amendment grants the citizens freedom of speech, which includes freedom not to speak.
The Fifth Amendment gives you the right against self-incrimination in fron of a tribunal or other court of law.
First Amendment: The right to free speech.
Fifth Amendment: This is a complex amendment with 5 parts, but basically it's the right not to incriminate yourself. The movie Casino, based on the life of Frank 'Lefty' Rosenthal, is a good example. He pleaded the Fifth Amendment 37 times while on trial, refusing to even answer whether or not he was nicknamed 'Lefty' or even 'left-handed.'
Miranda Rights: Stemming from Miranda v. Arizona, these rights are read to you upon arrest. The right to remain silent, anything you say can and will be used against you in a court of law. You have the right to attorney. If you cannot afford one the court will appoint one for you. Do you understand these rights...
