I believe, it is illegal to a point,as in, within are consequences. But, if there making "claims" they have to point out that there is no evidence and that the statement or product is not approved by the FDA on anything product they're selling, then i believe it's okay.

I would hope so. One would leave one's self open to prosecution for the failure of the product, and any unwholesome side effects that may occur.
