Self defense?
If your over 18 and someone who is a minor (let's say 16) attacks you are you able to defend yourself? I know it's against the law to fight a minor but if he attacks you first are you able to defend yourself?
You are allowed to defend yourself but you may not attack once the minor is subdued.
Of course but you can only apply equal amount of force.
It depends on the state and locality you are in. I have a friend who has a felony on his record. He had been working as a youth counselor working to prevent gang involvement. A gang member pulled a gun on him. My friend struck him on the wrist with a tree branch, breaking a bone. The gang member was 16 years old.
Since he was in Los Angeles he was charged and convicted of a felony.
In Oklahoma; where I served as a cop, an incident like this he would not has been charged at all. In fact I doubt I would have even put him in the car or cuffed him. Oklahoma has a wider latitude for self defense than California.
Check with your local Police or just ask around, someone will know how it works in your area.
COOL! Someone answered who has a pretty good grasp of self defense!
Once you have the upper hand, it is no longer self defense. Most people think you get an open invitation to whip his fanny if he starts it. BUT once you have the upper hand, it becomes a butt whooping, not self defense.
Answers:
absolutely! but the means employed to prevent or repel the attack or aggression must be at least commensurate or equal to that of the aggressor otherwise it could not be considered as self-defense
