Will a PA court uphold a noncompete if employer admits there is no consideration & did not understand contract
The employer got on the stand and admitted he did not understand his own agreement. It was proven that the consideration (since noncompete was asked to be signed was a year after working) was illusory. The employer's promise was optional at his 'own discretion'. The employer was also threatening the employee via email. This also showed 'unclean hands' on behalf of the employer. The judge also yelled at the employer on the stand for refusing to answer questions and not knowing his own contract. What is the likelyhood of this noncompete being upheld.
