Saw 3 people smoking inside bus shelter (No smoking under the law) However policemen turn blind eye..?
..when they saw 3 people smoking. Why Police doesnt enforce the law? I wonder? I am smoker myself but I do respect the law.
If no one is complaining about it, they probably wouldn't do anything. They have a lot more important things to do than cite people for smoking in a restricted area.
Maybe they were working on something else. Maybe they were looking for someone, or following someone. It would be silly to stop doing something important to start writing tickets for smoking.
maybe the copper smokes? or just don't want to get involved or have any trouble before his shift ends?
I think its the councils who give the fines out not the police. And I think certain sorts of bus shelters are ok. I doubt the police would be 100% clear on the rules as it seems no one is! It would be way too much hassle for the police to try and enforce every incident when the rules are so unclear!

You don't say if that is England or Scotland, but in Scotland you can smoke in a bus shelter, as long as it is not enclosed on more than 2 sides (I think). You can also smoke in common stairs as well (going into flats), which I think is wrong as those ar public places.
It depends on the shelter. If it was totally open fronted, it is still legal to smoke in it.
Bus company should enforce the no smoking ban, policemen should be out in the real world catching Bad Guys!!
The do the same when people pee on my front door after walking out of the pub which has a free toilet. And when they drop litter three feet away from a bin. and…and… and…! It's the people that are at fault. Big problem in this country. And I think it's getting worse. The police can't enforce the law, because they're not there to do it. They are being slowly replaced by cheap alternatives who are not there either and even if they were, have no power.
Get a life.

smoking law is a civil law not criminal law

Smoking in a banned area is a civil offence not a criminal offence, therefore you should report it to the company that own the bus shelter, it is their responsibility to ensure the smoking ban is complied with on their property!
Why should the Police harass people for something so trivial.
You take these things too seriously. 28% of people smoke thats about 28million. What do you want to do? Start a war. Its not as dangerous as you think or they wont be smoking. Live and let live. Remember the guy who got fatally shot for telling a bunch of guys to stop smoking. Its not your business.
The government just makes these rules to appease pressure groups for votes. They really dont care. If they did it would be banned in the House, which its not.

Only a few laws does a police officer HAVE to arrest. Most arrestable offences (covered mainly in the Police and Criminal Evidence Act 1984) give the police discretionary powers of arrest. They can choose when and where to arrest. Usually based on performance targets set out by the Home Office, the Local Council and the Local Chief Constable.
Without asking the officer, there are too many variables to try and suss why s/he did not do anything about it.
Because the police have better things to do, if they were smoking crack it would be different.
