How much is the higher sanction/penalty a company can be forced to pay for having done false/deceptive advertising?
In Italy it's 100,000 Euro and there?
Answers:
As you might expect, the answer depends on the sector in which the company operates and the advert.
For example, a life assurance company regulated by the FSA who advertises in a misleading way, can face an unlimited fine.
A pharmaceutical company who advertises a false claim can be fined by the PAGB (they regulate all packaging and advertising in that industry).
A law firm who makes a false comparative claim can be fined by the law society.
But these are all compnaies and firms who can be penalised by their own regulatory body becasue they are in breach of that regulatory body's rules.
.
The ASA who actually regulate advertising (in the UK) as a whole can require a misleading or false advert to be removed, but they have no power to levy any fine or other financial penalty.
Therefore the answer can be an unlimited fine, or nothing for an advert which is misleading in exactly same way.
it all depends on how bad they done it, it could be over a million pound, all the best
