Can detectives interrogate minors without a guardian or parents approval?
It's not about parents approval but parents need to be there.
yeah they did it to me all the time when i was a minor
Answer:
Detectives can INTERVIEW but they cannot interrogate. Parents of the minor must be called. It is imperative that you tell your child that the minute they say 'I want an attorney' that all questioning must stop.
Law enforcement officers on a whole hate dealing with minors. They have a total different set of policy and procedure to follow. They have juvenile miranda rights, they must be kept from all adults(prisoners) in jail or while they are being held.
Officers/detectives can use intimidation for minors more easily usually than adults. However, this is something that has become more of a necessity for law enforcement due to the crimes being committed and the age of younger offenders.
My son knows if he is ever brought in on any charge, the first words out of his mouth need to be 'Call my parents' and that 'I want an attorney'.
Hell yeah. I say interrogate them. Those kids out on the streets robbing and killing did not need a parent with them to commit the crime, then they don't need a parent around to answer to what they've done.
unofficially they can just about do what they like
i am sure that they can question youths that fall into their hands if the are suspected of doing something wrong .
who will be there to stop them ,
later if or when charged when things get oficial the law and the lawyers will get into the action
Teach your kids to DEMAND an att'y and you be present before they'll answer any Q's. Drum this into their heads like the advice about not talking to strangers.
Demand to see your child if they are arrested IMMEDIENTLY and RAISE HELL if they stall you.
Reading the news will inform you that adult cops can coerce kids into confessing to almost anything. Like Michael Crowe, who the cops physcologically tortured to confess to killing his sister, which was proved that he didn't do.
Demand that you AND an att'y be present before ANY interrogation takes place.
Also, tell your kid that cops are allowed to lie, lie like dogs.
