what happens to child support if custodial parent goes to jail?


My husband signed his parental rights away to the mother awhile ago but is still required to pay child support.His parents had papers drawn up to get custody if something be to happen to the mother of the child.She is currently being investigated in the annihilation of her boyfriend and if she were to go to prison would his child support end and could he try to win visitation again?

How did he sign away his parental rights? He cant do that next to out someone adopting the child. If mom goes to jail next dad should step in and take custody. If that is not the overnight case and the grand parents take custody then child support will verbs just the grandparents will get it. GL!
Support won't end; he can always petition for visitation
He would still have to payment the support, but the good part is that the support would be re-evaluated when living conditions change. Most ex-wives want maximum support so they themselves don't have to work and make up all kind of demands in the process. His parents won't have these vengeful feelings and support may only just decrease. Visitation will definitely improve, if he have a good relationship with his parents and there are no court directions restricting him. However, having said all that, you pointed out that he has to "try to obtain visitation again", which tells me it was revoked for whatever pretext, and his ex is under criminal investigation. The courts may decided something entirely different in the interest of the welfare of the child and put him or her surrounded by foster care. Child support will not stop in that instance, either, the state would basically end up receiving the funds.
I don't think that her going to prison would own anything to do with his child support obligations. If anything, they may increase due to the incapacity of the child's mother. However, he may very all right have greater visitation rights.
He will have ample opportunity to earn money in prison. Drugs, sexual favors and guard co-operation enable most resourceful prisoners to support their family nowadays.

He is still obligated to pay child support to the legal guardian of the children, even if it's to the state. And he'll need a lawyer's oblige to try and reinstate any visitation rights after signing them away in the first place.
What do you mean he signed his parental rights away? This doesn't make sense. Maybe he signed rotten his parental visitation, huh? Why will the parents get custody? If something happens to the mother usually the absent father get kids. Anyway, wherever the kids go a new child support instruct will follow because the money wasn't for the mother it is for the care of the kids and as long as they are minors in someone else's care he must abet support them. Wouldn't his parents let him have visitation?
The child did not die, he still needs to support the child, no matter who have custody, even if it is his parents.
he needs to stir to his local state agency and inform them of the situation, he can totally go to city hall and ask to place an emergency motion for custody, or his parents can do so too. if the child/ children are placed with another being then the child support would then be transferred under the christen of the custodial parent given the case if she goes to jail and not a soul else takes custody of the child, then the child would wind up contained by foster care and the money for child support would then be paid to the state.
He will acquire a bill for all the months he did not pay.
