Employee rights question?

I have been working in radiology for 6 yrs. Recently I found out I mismarked a film, and scanned another film wrong. This happened over a month ago. Both of these actions were wrong on my part. But I am human. These actions did not cause any harm to the pts but the dr wrote me up. I had a previous write up about the same marked wrong about 2 months ago. My manager told me yesterday (Friday at 1:30pm)that I am suspended pending investigation . I went up to the job to talk to him and the director. Stated that I need to look up these errors to see if anything happened that was not my fault and looks like I cleared one of the issues but the director said that if it comes back that I did mess up that I will be terminated. Is this right? We had an issue last christmas with someone marking a pt wrong and they put up a final warning as a memo to every one that if you mess up you will get a final warning write up and if you mess up again you will terminated. What about human error?

yes, there can be human error in the medical field & it should make you insane with shame & fear ... not trying to claim that this should be normal.

I think you should try to do the best you can for what you have scheduled & when you are off work - look into other jobs & leave before you are fired.

Yes, the hospital can fire you even if all this didn't happen & you made no mistake, but they picked up on your more casual attitude towards your medical work. I think it is a good thing that both employees and employers are free to come and go and hire & fire as they see fit to keep their business moving forward - it protects both sides & you happen to be on the firing side of this one ... but if you can step back, I think you will see that you have been lucky so far & that your attitude or sense of urgency is not matching your job & you need to transfer to another more appropriate job.

This is not a dig at you - I also would not be a good candidate to work in the medical field - but don't look for legal loopholes just to hold on - that will make your supervisors nasty to you, your co-works cold toward you and you will not enjoy your job even if you have managed to threaten them into keeping you.
There really is no leeway for human error when it comes to the medical profession.

An employer can terminate an employee at any time. While there are laws and regulations concerning termination, they are written in such a way that the employer can always find a way around them. If you are terminated, and you feel you were treatly unfairly, you can contact the Wages and Hours Division of the Department of Labor. Unless you can prove discrimination or some other blatant abuse, however, I doubt they will help you. The department has turned very pro-management under Elaine Chao.
Yes you can be legally terminated especially since they put up a posting stating such.
You should probably begin looking for a new job soon, one where you are free to make as many life-threatening mistakes as you'd like.
