NV probate laws?
My father in law just died in an accident, there is no will, does everything he left behind go to his wife he has been married to for two years? He told several people he wanted his daughter to have 1/2 the insurance money. What is the law with no will, and is there a reason to fight.she is being really selfish.
the ins $ goes to the beneficiary under the contract or the estate otherwise. NV is community property state, which means she is first entitled to 1/2 the money he earned or made in those 2 years only, unless she proves he gifted her more. The rest of the money is divided under statutory scheme between the wife and children, and the wife is given a generous percentage regardless of length of marriage. Under these circumstances, she will be entitled to a lot. You may want to fight it especially if she claims he gifted her much of his estate or there's an argument as to the ins money. consult a lawyer
Theres MUCH reason to fight..In cases such as these where there is no will then the family is looked at first, they well being is far more important then some non related person (blood relative, RIGHT?)..So YES, fight fight fight, you have every right to and things SHOULD go into your favor

In any case where someone dies intestate, the estate goes to the heir-at-law. In this case, the wife will be entitled to the whole estate.
If he wanted some of his insurance legacy to go to his daughter, he should have made her co-beneficiary on the policy.
