Is it illegal for friend at school to sell fake replicas of designer items?
She is selling jewlery sunglasses and pocketbooks...she says she is going to open up a store one day to sell this stuff...is this legal?
She is selling counterfiet items. This is of course illegal. She is selling in a school, this is also illegal. She is soliciting you, who no longer wants to be solicited...this is illegal...She just keeps racking up the charges.
I think it is illegal only if she claims they are real.
Only if she says they are the real thing.
Totally illegal to use someone else's name or trademark; it's called counterfitting, and she can lose all the mdse, get a huge fine.

Yes it is Legal ... Law shall go for the manufacture (who ever makes this it's Not legal)
No it is not legal.
I'm pretty sure it's illegal.
People sell knock-offs all the time, and as long they are telling the truth that they are knock-offs, it's legal. However, you say she is doing this at school, and I would be willing to bet your school has a policy against anyone selling anything there unless it is a fundraiser for school programs.
*****Sorry, I missed the part about the labels at first. That sounds like it may be counterfeit merchandise. Not good. There is a big difference in counterfeits and copycats, where the stuff looks just like it but does not claim to be the real thing by using the real name.
It is completely illegal.. It is called selling counterfeit items, and she can be arrested.
Answer:
If she is selling stuff that duplicates a trademarked logo, it is illegal and you would be wise not to buy anything from her. It doesn't matter that she indicates they are fakes if they have a real designers logo.
If it is discovered, the goods (including what you have bought if she tells them who she sold stuff to) would be confiscated and she would face criminal charges and severe financial penalties.
Here's what Ebay says
Counterfeits, unauthorized replicas, unauthorized items (such as counterfeit watches, handbags, or other accessories) or unauthorized copies (such as copies of software programs, video games, music albums, movies, television programs, or photographs) are not permitted on eBay. Unauthorized copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged. It is illegal to sell unauthorized copies of media.
eBay urges sellers and buyers to comply with all governmental laws and regulations. Since the sale of counterfeit items, unauthorized replicas and unauthorized copies is prohibited by law sellers may not list these items on eBay. This policy helps protect buyers from purchasing counterfeit or fraudulent items, helps protect intellectual property rights owners against infringement, and helps create a safer marketplace.
The reason they have this policy is because selling counterfiet items is illegal. It doesn't matter if you say it's counterfeit.
what is a 'fake replica'? if it's a replica, it's fake, by definition
