Parental consent has no legal standing in a statutory rape case in most states. It depends on the laws of the specific state as to how old a person must be to give consent... in NY you can give consent, yourself, at 17.
Parental consent for what? The verbal statement is only good as long as the parents continue to agree to the verbal statement. But, at any time, the parents may decide to change their minds and say, no, they didn't say that. Then the verbal statement is useless. Anything written is always better. However, if the child is a minor, the parents still have legal guardianship over that child and can rescind a written agreement as well if they then deem that it is not in their child's best interest.
