Do you think the punishment for the mother who threw ice into a car that cut her off twice was extreme?
am a State Trooper and deal with this kind of stuff on a daily basis. Yes, I think most sentencing is way too soft, but this case was taken way out of hand. Yes, there are different levels of punishment.......they are called class A, B, C and D felonies, etc. She didn't hurt anyone, so it should be a lesser sentence. Any jail time for her is insane. I see drunk drivers who have killed people not get any jail time, ex. The St. Louis Rams defensive end 'Little'. I have been in pursuits with Meth cookers who had 7 previous felony arrests for meth production and they got less jail time. I arrested a guy for his 6th dwi, he had only done 120 days of jail for the previous arrests. A buddy of mine got the same guy for his 7th dwi, how was he not in jail and able to get his 7th dwi arrest. We can write in 'road rage' on the tickets we write to add a bigger fine. In my opinion, she committed a misdemeanor assault, by road rage and it should have been punished accordingly. Two years i
It's excessive when compared to other crimes, but it's totally appropriate for what she's done. She could consider herself fortunate that she didn't kill somebody or she'd be in jail for longer.
i believe it should've been a pollution case... i mean what makes ICE a missle?! rofls.
Yes, the punisment was way too severe. I'd say a 100 dollar find would have been about right, but some judges are not used to using common sense.
Everyone with a little of common sense, would agree this punishment is extreme....In while, Howard Stern is getting away from the murder of Ana Nicole Smith and her son.
Naw - this act could have ended up with much more serious consequences, if her actions have caused a major motor vehicle collision.
Its another example of big brother. Just like the border patrol officers being jailed. I totally believe there is some other reason these men are being held in jail. I think they will never leave that jail because they know something there not suppose to tell. Got help our country. We are slowly becoming hitlerized. If you are a stat trooper you know all too well what I am referring too.
I heard that she got 'probation' in lieu of her two year jail sentence (according to Foxnews). What is so 'harsh' about that?
From the details I heard, she threw (in anger) the 'missile' inside of another moving vehicle (I'm guessing it was a convertible or else she was a pretty good shot). In my mind, throwing any object (missile) at (the outside of) a moving vehicle is dangerous enough. However, throwing a 'missile' at the driver of another moving vehicle is much more serious. Thank God that she didn't injury the other driver much less cause a serious TC (traffic collision).
I think she 'got off' light because she had several small children and her husband is serving in Iraq.
.
I believe it was excessive. I think the jury was thinking more of what could have been the possibilities of causing a fatal accident from the ice being thrown at a weak windshield. It could have caused a distraction, the driver could have taken their eyes off of traffic for a second or two which could have caused an accident. I see your point of view in comparison to other cases. There does seem a double standard with certain crimes and the kind of penalties that are given out. But, this case shouldn't be compared with those other cases. Each one should be based on its own validity.
I would have had her attend a defensive driving class, maybe go get analyzed by a psychiatrist to discover if this was due to a long-term emotional problem or just a one-time occurence, and I would have given her 6-months' probation.
Extreme ya I'd say so how about I'm sorry I'll clean your car you pay for your laundry. My God are we getting that nit picky let this woman get back to her family i mean gezzzz her husband is in Iraq and she had 3 kids and pregnant sister in the car come on how many of you out there wouldn't have lost it at one point !!!!!!
I think 2 years behind bars is a bit extreme. If I were the Judge, I would have given her 90 days in jail, $1000. fine and suspended her license for 1 year.
She should receive some jail time based on what might have happened if the cars were actually moving at the posted speed limits.
You being a Trooper know quite well the legal system is falling down on the job. Too many acts are just brushed aside in the court rooms, and then the public can't understand why so many acts happen....criminals know the chances of spending time are slim. So it has to start somewhere.
Answer:
i certainly do trooper. Over here in the UK we have similar situations with gangs causing a whole load of problems and getting community service yet the minute an honest citizen takes the law into their own hands they get 5 years in the big house
Keep up the good work
