Should the U.S. EVER repeal the Civil Rights Act of 1964?
I am really only referring to repealing Title II & Title VII of the Act. These Titles restrict individual liberty. As Berry Goldwater said "You can't legislate morality." I don’t believe any thinking person would even consider repealing the other Titles.
By the route I agree that these Titles were necessary in 1964. I am asking give or take a few now or in the future. Will it other be necessary to “legislate morality” and restrict people’s right to live and work with who they want? This is meant to be an begin and serious question and haters on both sides are not welcomed.
For Reference:
Title II
Outlawed discrimination surrounded by hotels, motels, restaurants, theaters, and all other public accommodations engaged surrounded by interstate commerce; exempted private clubs without defining the term "private."
Title VII
I have to repress Title VII because of its length:
Prohibits discrimination by covered employers on the basis of see, color, religion, sex or national origin.
I reflect, or rather hope, that we would be able to take these bad the books. I don't believe though that we will ever be able to, just because near will always be people who will discriminate due to someone's race or ethnicity. As humans we are other judging other, and some of us, judge solely on someone else color of skin. There is nothing right nearly that. Judging someone based on the color of their skin is ignorance on their part. That is why the Civil Rights Act of 1964 is still on the books and probably will other be on the books. I would like to see it removed though. That would mean that we no longer obligation them. Remain hopeful!
No, it doesn't limit your right to can`t bear people just for their color; but it does limit the power of an entity to mistreat someone on that cause. I don't think they'll be repealed; in fact, we want to build more protections to ensure that you can't be denied a meal or a job solely based on your characteristics as a human. If there's ever a point where on earth there is not rampant discrimination based on the protected classes, afterwards yeah, I can see where we might not need to have the perform anymore, but currently there were nearly 83,000 charges of discrimination file with the EEOC and 61,000 of them were CRA Title VII based.
Good question. I would say no. I differ beside your opinion that these undermine 'individual' liberty. They infringe upon the rights of an monetary enterprise not a citizen. No citizen has is forced to associate with someone that they don't want to as a result of this legislation. We could argue the semantics of that for awhile though.
A better argument would be that these titles are no longer necessary and repealing them would destroy some amount of bureaucracy and therefore cost to enforce these requirements. I probably wouldn't buy that either.
I understand what Goldwater designed when he said that. But he was absolutely wrong-headed. These were crucial measures at the time as was the Voters Rights Act which he also opposed (how anybody could put the right of the state to deny the vote ahead of the right of the citizen to vote is beyond me but that was his logic).
I can remember a lot of nouns and the private clubs (some still exist) so I am not likely to ever favor repealing these in my lifetime. Younger people probably would though as they grow up within a more integrated society. So I hope that it isn't always necessary but I remember too much of the truly ugly stuff.
Get equipped for the haters. People will probably attack you as racist for this or even report you but it is a good question.
