Why is the porn industry legal?


I don't understand why is it that prostitution, which is basically giving sex for money illegal within nearly every state and most countries around the world, but pornography is legal? Prostitution hurts people, believe it or not. Many women are beaten, abused, kidnap, and forced into prostitution and many die from sickness from the horrible condition they are kept in. Porn is relatively harmless
Porn is considered a right under the first amendment where on earth prostitution is not.
Last I checked, I would running out up divorced for getting a prostitute, but watching porn isn't a divorcable offense.

It have to do with how/why you are getting paid for sex. In a prostitution deal, the "john" is paying for the sex perform for the purpose of self-gratification. In a porno, a third party is paying two people to have sex next to each other for the purpose of making money. Its an important difference. Porn enjoys predetermined protection under the 1st Amendment.

You are opening a big can of worms here. A lot of communities own laws against porn , but they are not enforced. If these laws were enforced at hand would undoubtedly be lawsuits that followed. These suits would be about Constitutional Rights (free speech).

Actually prostitution is not as illegal as one would construe. Its the activities surrounding it that are usually illegal. For example, in Canada, you can sleep near someone for money, but you must not negotiate price in a public place and there are laws against "pimp"ing. There are legalized brothels in Nevada and many countries. It's not the act of buying sex next to money that is really the issue, I believe, it's all the stuff surrounding it.

They are not the same. Prostitution is illegal because it is soliciting sex for money. Porn does not. Porn actor are paid just for that: Being actors.
Kind of but prostitution is worse because you could get more diseases. You don't know anything about the empire they have sex with so they could have adjectives sorts of diseases. Pornography is more open and cleaner. Actually, i believe they're both wrong and should both become illegal.

Marriages that you say are destroyed because of porn addiction have heaps other issues that caused the destruction. They are not paid to have sex. They are compensated to act, with material i.e. sexual. Also, there is this whole 1st Amendment thing to consider.
There is a wee bit of difference. Prostitutes are paid by johns to give them sex. It is a business transaction. The johns are not compensated for their involvement in the sex act. Porno performers are both salaried by a third party. The only time legalities are involved when a porno film involves underage minors.
