Can I leave the my state before I go to court so I can attend my grandfathers funeral?
I was recently charged with harassment and assualt in the third degree and since I had no previous crminal history, I was let out on a PR bond, but I have to go to court again May7 for my pretrial. Now my question is I live in Colorado and my grandfathers just passed away yesterday but he lives in New York. So can I go to his funeral in New York, or can I not?
i did and never went back. i think you can if you get back before your hearing date. if not you can petition the court for a continuance, which will postpone your court date. you can also ask the judge, since you have no priors, it should be ok. you will probably have to come back with a copy of the obit.
Well, that was dumb.
Ok, on to the question. Unless the judge restricted you to state, you may go. I don't know what a PR bond is though.
If you have any type of overseeing officer such as a parole officer, contact them (not us).
Sorry to hear about your grandpa.
Answer:
One of the terms and conditions of a bond are that you remain within the jurisdiction, which could mean that you a restricted from leaving the county you reside in without approval from court. You can file an EX PARTE MOTION FOR PERMISSION TO TEMPORARILY LEAVE JURISDICTION. In this motion you must articulate to the judge your reason for leaving, your departure and return date, that you are not a flight risk and that you will return to court as scheduled.
If you will not return in time for your hearing you must concurrently file a MOTION TO CONTINUE, which may or may not require the signature of a prosecutor before it is filed with court.
Go to the funeral. Anyway, if you are unsure, call the court clerk's office and ask if there are any restrictions to travel. I don't think there will be. Just be sure to show up for court. Missing court is an automatic bench warrant, and that can be worse than the charges against you now.
Who did you assault? I pulled a gun on a guy once. Put it in his face. The police came but I did not get arrested.
