Fell for online scam, need help!?

I own a restaurant, i have been using an email advertising service for nearly a year that claimed they have a LOT more emails then they really do. To say i'm upset is an understatement as i have spent thousands beside them.

Now i know they are located in my state, i can prove they do not have anywhere near the amount of subscribers they claim and when i originally made the accord with them i asked them via email how many subscribers they had and they responded beside a number (i still have that email).

I want to know what i can do about this legally as they hold ignored all my requests for a refund.
In other words what criminal charges could they frontage and what can i do to them in civil court.
larceny by trick as a criminal charge or fraud as a civil bag

but good luck getting the cops to pursue a larceny by trick claim- too complicated for them
Well lets see, they have committed business fraud. What thoughtful of documents do you have? Do you have a contract? If you do, and the contract stipulates a certain agreement, and they did not abide by their portion after you have, breach of contract, failure to preform. What you can do in civil court is, sue them for your money put a bet on, sue them for failure to perform, and breach of contract. What you would get, is your money spinal column ,and any other restitution the court deemed fair. You have to sue them for breach of contract if they promised something and didn't deliver on it. You hold to read the fine print. I bet they had a line in the agreement that said, "not responsible for guaranteeing subscribers" or something. Get an attorney!
