my son has a child but the mother wont let him see her and she also ask him to sign over his rights but he did not so she went and got an epo on him for no reason and he did not know went to see the child and she called the police so i need to help my son
Get an attorney and fast! My ex husband took my two children to Washington just for a 2 week visit he said. Well, he never came back with them and went and hired a lawyer and took me to court for custody, then he enrolled them in school. I took them back while he came to Montana to visit. See, we agreed to meet in a public place outside for a quick visit as he was on his way back to Washington from visiting his family. When he had his back turned for a few minutes, my teenagers grabbed the twins and we drove off and left him standing there, but I got served with court papers within that week and was ordered to give them back to him. I ended up in a dirty court battle out in Washington which cost me a fortune. Right now I have visitation but a very bad court order with limited time, like only in the summer and certain holidays. He won because he took me to court first and lied and had much more money than I had. Right now I am wanting to try and regain full residential custody again, but I am just not ready for another court battle. The twins are now almost teenagers and will be able to choose for themselves soon who they want to live with. For awhile their father was being reasonable and not going by the full court order until he got remarried. Now he is up to his same evil ways again. Please tell your son to seek legal help now, before he ends up like I did. At least he can get joint custody which is better than I have. This woman has no rights to do that to your son.
get a lawyer go to legal aid they will take your case for free in most states the mother can do anything she wants to and if your son is immature and not willing to work and is on illegal drugs then yes but you should first go to court and file for custoidal rights so your son can see his child in family court and you as a father have grandparents rights they might set up counsling for your son and if they do make sure he goes then get the counsler to sign a paper everytime he goes then get it notirized even if they want him to take piss test have them sing everything and get it notirized and even with drug counsling and anger managemnet classes

An unmarried biological father has only what the law calls 'Assertive' rights, those rights he himself asserts before the court.
They include signing of the Acknowledgement of Paternity upon birth, filing for custody/visitation and a petition to require paternity testing and a finding by the court that he is in fact, the child's father.
All of this can be done without an attorney, but it is not advisable. You, on the other hand, have no such rights and are not a party to any legal proceeding.
Therefore, I would suggest your son either visit with an attorney (family law) to begin the process of asserting his rights, or visit the court clerk's office to ascertain what forms are required to file a Motion to establish the parent/child relationship including a petition to establish custody/visitation.
