Yes, they can indeed. Bed Bugs are a serious problem and they CAN be prevented by properly cleaning the room and laundering the linens. Bed Bugs live in the wood of the walls, usually. They can stay dormant for over a year, which makes them tricky to kill. This doesn't mean the hotel isn't liable. The hotel should, instead, include a disclaimer of liability in their contract.

I don't think you can actually contract them as they don't live on people. But, if you get bit by them at a hotel you could definitely complain and should be able to, at the very lowest, be reimbursed for your stay.
