Law Question?

I have a band that has recorded some songs, but they are not entirely our own. We did remixes of other people's songs by our own instruments, voices, and recording equipment. They turned out very well(well by the majority of our audience of our audience's reactions)Are we allowed to sell these songs or do we need some type of liscense?

Yes, I'm aware that anyone can answer this question, but I'm going to research the answers and after you post them

Answer:
When you 'remixed' the songs you were sampling. In order to market and sell anything with sampled material, you will have to get the permission of the artist who originally created the song. If you don't you will leave yourself open to all kinds of lawsuits. You don't neccessary have to pay anything for the use of the material, just get an okay from them. Remember The Verve fiasco with 'Bittersweet Symphony'?

Also, before you put out an album make sure that you're material is copyrighted so that someone doesn't 'steal' it.

I am a law student and my husband is a shredding Metal-God :0) We've done countless copyrights of his material.
