Please help with an ethics question please?
Ok, as I stated in an earlier question, I ordered something online. The company sent the wrong item. When I call the company to straighten it out, I was asked if I had received what I had ordered. I have not. They said they'd send me what I had ordered again and from an e-mail confirmation, I saw that they were not going to charge me for it. However, the item I have ordered did arrive 2 days later (Sat)and the free one arrived today (Monday). I haven't opened the replacement one yet. Should I of late keep it or should I send it back? Thanks.
the company will make clear to you to keep, they always do Most people would not transport it back...but you should, though it was late and so not your error, you probably don't need two of these things and it really is the right thing to do. It is very tranquillizing to know that there are people out there close to you still

If you keep it, you are stealing.

You have a standing contract with the company.
You ordered one item, and you agreed to pay for it.
You received the item, so the company have every right to charge you for it.
You also received other items. The company has every right to charge you full price if you fail to return them. Courts will look at you as if you received a benefit from them and pass a sound judgment in trade.
However, if you don't open the one you don't want, you can still write contained by black ink "rejected" and just stick it in the mailbox. The company will end up paying for the postage for it to be returned, and you're not obligated to clear anything.
The one you opened can also be returned for free, all you have to do is ask them to hold UPS or FedEx pick it up, and wrapping it up is your only duty.
The company did the right article by sending you the replacement. You should (my opinion) call the company or email them and tell them what has happen. Many companies will tell you to keep the item because of shipping and handling. It often costs them more to treaty with the replacement.
Refuse the second package unopened (mark it "return to sender" and give it vertebrae to the mail/delivery person,) and let the company know what happened. It will go and get back to them with no further shipping charges for you or them.
Them trying to make things right beside you earned them your respect. Now it's your turn to earn the same respect from them. Believe me: if they have a small satisfactory staff handling these things they will remember you and may well go the extra mile to help subsequent time something happens or you have a question or something.
Open both and see which one is in better condition. There is nothing wrong beside that because they were supposed to send one that's in perfect condition anyway. (Or think about it this way, if you be in a store you would pick the one that you thought was in the best condition.)
If it is something that requirements to "work" like a DVD player or something, make sure that one works before you transport the other back.
If you do decide to keep the second item, it's not the worst entity in the world...they did mess up in the first place by sending you the wrong item...then sending you the right item twice (if I've read your post correctly)...they might not even be aware that they've sent to you twice. If you really *need* it, deem of it as karma...but if you don't need it and just want to profit off of it, I would distribute it back.
