Why.............?

Is everyone so sue happy? I mean some people want to sue because another person looked the wrong way. What is up with frivilous lawsuits? Whats the worst one youve heard?
Counting chickens before they hatch and there total hate for each other. Pathetic!
Because it's the quickest way to get money. I swear, that's all people are thinking about.
Why work when you can sue and get rich?
I've heard some bad ones...but the one I like is thew fat kids that sued Mcdonalds for making them fat.

Its ridiculous...sue a fast food company for making good tasting food and turning a profit because you had no self control and decided to get fat off of it?
It is partly something we learn. We lose in life, we win in the courts.

Partly I think this reflects our inidividual pain in life. We use legal action to say, my life is bad. But unfortunately we can't sue life (or God) but an individual or company.

In addition there is the financial reward. Sometimes, like an accident, the cost of care is very high, then we have no choice but to sue to recover costs. Other times it is simply the fact we can make a lot of money.

The problem in the US is that the juries have the power to decide how much money is paid. While in other countries the judge decides. This means the pay out in the US can exceed the real damage, so legal action in the US often pays off big time.
I am a trial lawyer and I agree with you that there are too many frivilous lawsuits. The true frivilous suit is brought by greedy and opportunistic plaintiffs, aided by greedy and opportunistic lawyers (they are in a distinct small minority in the profession).
The worst I ever experienced was brought by a big insurance company against a school district seeking a declaration that they owed the school district no money. The policy of insurance was clear. After their scummy attorney ran up his bill and after a federal judge dressed down the lawyer, the insurance company paid in full, including the attorneys fees of the school district.

Answer:
K,
Early in the last century, America went through a deep depression which taught people to live responsibly. I'm sorry to say that people who haven't experienced povery or learned to be responsible don't know any better (they don't appreciate what they have). I guess they don't even understand the hardship they are creating. On the other hand frivilous lawsuits are a response to an irresponsible government. They are also a way of lashing out at frivilous laws.
I guess they just want to make lawyers rich, since a simple straightforward letter to the potential defendant of such a lawsuit explaining what they are unhappy about gets a little more than half such problems resolved with a simple apology.
