My brother stole and sold my jewerly. What can I do?
My brother was living with me for a few weeks. One day I came home and found a pawn shop ticket in the trash with jewerly on it. I went to my jewerly boxes and found out things were missing. He admitted to stealing them when I kicked him out. I called police to file a report and they said since he was living in my house he was able to steal from me. I called the jewerly store to try and buy back my things but he will not sell them back to me because I can not prove they were mine. Is there anything I can do to get my things back? Someone please help.
thx
Call the police, he is a common criminal.
take him to court.
ask your brother politely to work hard in order to give you a refund. if it doesn't work, try to have a talk with him and try to record on a tape what he has to say about what he did. Once it has been done, go to the court. good luck.
You should be able to redeem the things with the pawn ticket. Otherwise, you will have to sue both your brother and the pawn shop.
Can you not produce a witness that knew those pieces belong to you? The pawn broker doesn't want to sell them or redeem them back to you because he loaned a tiny portion of their value and when they are not claimed, he will make a large profit.
Most municipalities and counties have stringent rules for pawn brokers. I know that the police have not been all that helpful with prosecuting your brother, but they might be able to offer some help with the pawn broker.
Answer:
Your brother deserves a good beat down, first and foremost.
With a filed report, and a detailed description of what of yours is missing, they--by law--must collect the jewelry from the pawn shop in order to process what has been done.
Then, by law, it must be returned to the original owner after--if there is one--the court process has come to term.
The pawn shop dealer cannot keep and resell stolen jewelry. It's something along the lines of a felony.
If he is above 18 years old you can sue him for petty larceny, unless your jewlery was over $1,000.00 then it would be grand larceny.
