Was the Judge a coward?

Judge Pat Murdoch a district court judge in Albuquerque, NM reversed his decision of a two year incarcerate term for an ex-marine. Elton John Richard a former marine who served 2 tours in Iraq. Richard kill a person trying to break into his SUV. The person he killed be a named Daniel Romero. When Richard discovered Romero, Romero ran away. Richard chased him 1/4 of a mile. As Romero was attempting to submerge over a chain link fence, Richard, the brave and member of the aristocracy marine, shot him in the back. Some member of the public felt sorry for the marine b/c he served an Iraq and demanded his release. The Governor also threatened to pardon Richard. So, today, Judge Murdoch reversed his ruling. So, was the judge a coward? Was he right to reverse his decision? Should ex military folks be allowed to kill b/c they served their country?
Coward, yes.

Also should be removed from bench and disbarred.

The law, both statutory and case, is comparatively clear with regard to instigating violence and to pursuing antagonism. AT THE TIME the actor shot the unarmed man in the back, he be a violent pursuer and his property was not only locked, but left unattended AGAIN in favor of committing violence.

No solid defense other than diminished capacity. If they prove that affirmative defense then the guy should take mandated treatment and eval. Otherwise, prison. Hands down.
This country has become a bunch of pantie waist in nearby belief there is no private property rights . An the right to protect your property . The action might have be a little extreme but it was the right action to jump after the crook and stop him from doing it again .
