if goverment delcared martial law on us can we delcare it on them. SInce we are the real goverment. I find this law pathetic.

The Declaration of Independence states exactly this principle: the American citizens, if governed by an oppressive tyranny, have the right to throw off its government and establish another in the way they sees fit. It was operating under this principle that our Forefathers rose up to secure our nation's independence from the British. But this principle is theoretically still in effect.
Of course, if you declare your independence and want to overthrow a tyrannical government, be prepared to fight and win and consolidate the power of your people.
