What is the statute of limitations on a claim for a car accident that happened over a 8 years ago in Missouri?
I got into an Accident 8 years ago, and went to court, Well i didnt have insurance at the time and i be ordered to pay the deductable of the person i hit i did, all sovled. Well going on for a year later i got a call from the person's inssurance company aphorism i owe 7000 dollars and i told them i don't have it. Well they put into the state of missouri and had my driver's license suspended. I joined the Air Force and get stationed in Germany. Not once over the past 7 years have i be contacted by the insurance company to get their money, nor have they tried to take me to court. So i be wondering is there a statute of limitation on an issue like this, i am coming backbone to the states and would like to have my drivers license back inflict i have a family now and no longer a irresponsable kid.
You still enjoy a few years before the statute runs out on this one. Since this was a court-ordered judgment, the statute of limitations for them to thieve action to collect on it is 10 years in MO.
If it had not be a court-ordered judgment they would only have 5 years to bring in the region of a court action in MO.
These statutes only apply to MO. All states hold their own statutes.
UPDATE: I missed the part where you said you paid the court-ordered deductible. Okay, the $7000 is not really "owed" because they own not obtained a judgment against you for that. Hey, I could say that you owe me $10,000, but I wouldn't enjoy much luck collecting without a court order to back it up. Their statute of limitations to bring a court performance against you expired 3 year years ago. If they attempt to file in court against you now, you can counter by claiming it is a time-barred debt and the casing would be dismissed.
I believe there is a 7 year time frame for car accidents surrounded by most states in which you can file. Medical malpractice is only a 4 year time frame, which I mull over they should increase, but thats besides the point. Regardless, there is not much you can do after the statute of limitations time frame has come and gone. I don't know about Missouri but most states won't release them until you earnings
