What happens to the mother if she withholds a child and you take her to court?


The court will prefer if she has a valid reason for withholding the child if she does not then the father can bring back visitation. She has to abide by the court order. If she does not then nickname the police and have a copy of the order and they will make her follow the court information. Nothing without a Court ordered custody agreement. If she violates the custody agreement she get fined, if done more than once she go to jail.
Is there a custody/visitation agreement within place, and is she withholding the child from you on your time? If so, then she is in contempt of court and child concealment is a Category D felony... she would be in big trouble.

If not, next you have much less leverage. You can petition the court to establish or modify child custody.

WHY is she withholding? Does she have legal reason to believe that you may cause harm to her or your kids? Do you hold a violent or aggressive past? If so, then she is acting in reason. The burden would be on her to show that she had valid reason to be concealing him/her.
The court will order her to let you have visitation. If you already enjoy visitation she will be held in contempt of court which could mean jail time and/or fines. If it still continues she could lose custody.
