I am trying to get my money back from a trip that I booked and can no longer go on.?
I originally booked a trip with twin anchors houseboating company. I had enough family to come along and had to book the trip early to reserve a boat. I then salaried the full amount and had people bail out on the trip. I contacted the company and asked if they could refund everything but my deposit. they said that I could not bring back a refund for anything I had paid. A regulation buddy said that if they have ample time to resell their product by law they had to mitigate the contract and compensation me everything but the deposit. I was wondering if anyone had every experienced anything similar and had any design as to what I, by law, am entitled to?
Your law buddy should also explain that the whole point of the deposit is surrounded by case you have to cancel, and explicitly enough in the form of damages. Look at the reservation contract and see what's up, and if they refuse to grant you anything go to small claims.
Your buddy is right about the selling of the product, but it has zilch to do with having time to do it, it is about if truth be told reselling the product.
If you don't have travel insurance, then you're basically stuck. They company can, if they would close to your business again and the business of anyone who knows you, then they should refund everything but the deposit, but they aren't bound to do so. Most put that surrounded by the original contract that you signed but in small print. The only opening to get the money back is to have travel insurance and to hold documentation as to why you can't go, like a medical emergency or something. Even then, it take a long, long time to get the money back, but you would get most of it. primarily its time for small claims court. in all honesty,a lawyer wont bring back involved in anything that doesn't amount to a lot of money. I'm talking path into the thousands.its not worth their time. take the company to small claims and plead your case.
