How do we set up a power of attorney?
My husband and I are going to mexico for our honeymoon. I am wondering how to set up papers to give my parents temporary guardianship. In the event that something happens to us permanent custody. As well as the right to make medical decisions on our behalf. We need to make sure it will stand up in court because my husbands parents will fight for our son. My husband and I both do not want them to have him. We don't have the money to hire a layer. Can we do this ourselves?
The rules for these types of documents will differ depending on the state you are in. You can draft these documents yourself as long as you follow the rules regarding notarization, witnessing etc. Check out www.findlaw.com - there are form POAs and HCPOAs there.
The only real way to know if your documents will stand up in court is to consult an attorney. I would recommend that if you are worried about a contest with your husband's parents.
If you don't have the money to set up protection and health care authorization, You probably don't have money for a trip to Mexico and you definitely can't afford to get married. Your priority account is bankrupt.
