Homebuyers rights?
We are purchasing a mobile home in Maine and the previous owner has had over 2 months to move their things and they are still not moved what rights do we have pertaining to the contents of the home? (ie. do we have the right to pack the things and store them for her?) She is very ill, but we have offered to have her there and we would pack for her and she still refuses. We have been very nice to her and have tried our best to settle this amiably, but we can't seem to get her to move! In the meantime we are stuck living with family members AND paying bills on the home. Please help!
Answer:
What is the close date on the contract say? States like Florida have buyers able to take possession of the home on the date of close. Other states have a lag time. It all depends on what your contract says. If the terms and conditions of the contract are not met, nor are agreed to extend then you are free to walk away. This is why every Realtor I know of will advise against the owner staying past close, or letting the buyer come in early. If you have already closed on the property, go to court and get an eviction notice.
Talk to a lawyer. I think you can get her evicted or arrested for trespassing.
