father of my child threatening to take her away from me! please help!?
I left my fiance a few months ago, its been on and off since after although me and our infant daughter live elsewhere. He has been so adament about him seeing her lately that he said to me if i dont agree to him watch her for a while sometime then he is going to come over here and take her out of this house when I am at work(she stays next to a sitter). He says he is coming over with the police to get her and since he is the father he can do so. He never signed the birth pass and we were not married, what rights does he have regarding this?

if your fiance did not sine the birth certificate and you wernt married he has no rights , if he dose go into your house and take her , he is comiting , home invasion and kidnaping .
Well, I'm not sure about legal rights, but morally, it is his RIGHT to see the child that he produced. Simple, don't be selfish near his child. I would say the same thing if the situation be reversed.
He's threatening to kidnap your child - that's unofficial. Call the cops and get a restraining order, and if he does come to snatch her, he'll be caught and probably do some hard time. He must find a court order for visitation rights, and no judge will give him that if he's threatened to snatch her. See a lawyer. In the meantime, assume that he has no rights over the child if he didn't sign the birth certificate. Your daughter desires to be your first priority.
I don't know where you live, but if he never signed the birth certificate he could be kidnapping. Unless he is paying child support, which may make available him some pull. You should talk to the police about this ,possibly you hold reason to get a restraining order contained by which he is not allowed within so many foot of the child and /or yourself. Make him take a blood test and pay up to date if he is her father and does enjoy rights. If you feel he may hurt her or abuse her, ask for chaperoned visits, where on earth a social worker is there while he is with the child, untill he can be trusted. Not married, NOT ON BIRTH CERTIFICATE... and someone tell you that he has the right to take the child??? Uh... nooo. He could be charged with kidnap. Saying he is coming with the police is a THREAT.. I guarantee you, the police are NOT running around in the middle of custody disputes, and without a court charge, it is not even a custody dispute. He is making a threat, pure plain and simple. IF he wants any rights, he has to file near the courts, PROVE that he is the father.. and even then, the court is not necessarily going to give him what he wants. Is it morally right to allow him surrounded by her life?? YOU MAKE that choice, until a judge says otherwise. LEGALLY, he have no rights whatsoever.
Depends how he intends to prove he is the father of the child. If it is common expertise among your family and friends then that really is all the proof he wishes. He definitely has every right to see his daughter and his threats would only be, person made because you're being a selfish cow. Stop using your child as a pawn contained by your game and let her see her father. Think of your daughter, not yourself. I'm sure she would like to see her father, you hold no right what so ever to keep her from him. A child has the right to see, know and interact with both of their parents on a regular foundation. If he comes over with the police and takes her he is not committing a crime in any rage, let alone home invasion and kidnapping.
Is there any reason why you do not want him to see the child? If not, sit down near him and be the better, more mature person and agree on a schedule. If so, telephone legal aide and find out your rights. As for the last question, within is absolutely nothing he can do legally if his mark if not on the B.C., and you were never married.
