can i sue someone on ebay?


okay hi i sold a sidekick lx brown on ebay and someone told me that they would buy it so i sold it to them and shipped it. now they tell me that phone doesnt work but i know it does work. she told me 3 different things thats wrong with the phone so i will repayment there money. my mom thinks that they would send me a phone thats not mine. so if that happen can i sue that person

well yeah. but you have to prove they did that.
That is why you bring back insurance on the package. In that case, you would say the product be damaged during shipping and file a claim through the shipping company.
Next time you sell something write down the Model Number. No you cannot sue, it wouldn't stand up in court.
Sueing someone for an Ebay transaction is a logistical nightmare. And if you don't live in the same state, you might hold to travel to that state with the judge's orders to give to the sheriff within her county. And you can't even leave feedback against the buyer, as Ebay has become anti-seller. This is why many former seller no longer sell on Ebay. Plus I think your mom is right that the phone you will get returned is not the phone you sent. So don't distribute the refund until you have the old phone contained by hand.
