death of parent, step-parent takes everything?

I'm posting for a buddy of mine. his mother died 2 years ago. there was no will, and his step-father took everything. closed all communication beside him, and calls the cops everytime he goes near him. lower than ohio law, does anyone know if he is entitled to anything based on blood relationship ??? that he could fight surrounded by court and get part or full of the settlement and insurance money ?? he's low on money, no job, and steps away from signing up for the military.. i'm looking for adjectives options for him.. any ideas ???
Best Answer:
If near is no will, the spouse takes everything in most states, unless there are dependant minor children. Certainly 2 years subsequently he can't come back because he's low on money. Doesn't work that way.
You need a attorney
Honestly, that would be next to impossible. By canon the, "next of kin," is the spouse not the children. Unless there was a will specifically naming him beneficiary to consistent assets, all the assets go to the spouse. Sad but true.
your buddy needs to talk to his attorney.
getta lawyer and im prety sure he gets something. his stepdad sounds like a d*ck though within is deff something for ur friend why else would he be so scared of ur friend??!
Yes he needs to gossip to a lawyer that deals with estate statute or family law. And sue the step father if he knows that his mother have a good deal of money left behind.
