im in califorinia owner is telling us to move out? is this legal? in good health.. she called my mom and told her that she wanted us to move out and that she wanted to live nearby.. so i guess were being evicted? on may 25, she told my mom to leave by the first morning of july.. jgiving us just over a month to find a new place... is this legal? she didnt show any documents or she desnt call for to have any? she just tells us we obligation to move and asks for the rent for june... and my mom refuse to give it to her.. so i dont know how the law works... so can anyone explain to me how this works... can she see us out..? do we have to pay rent even though this is our last month?

Yes, California decree says you can be evicted if the owner wants to move in. However, they hold to remain there for a certain amount of time (I believe two years). However, she does have to follow procedure, which system a written 30-day notice. If you gave her first and last month's rent, you don't requirement to continue paying rent. Give her written notice that you are applying the last month's rent.

You have left out some details but if you don't have a lease, you enjoy to move and pay rent as long as you are there.

Depends what the contract says. If there isnt one consequently you technically never had to pay rent and they could make you confer on aat any time.
I believe it all depends on the contract you or your mom signed upon moving into the home. A month's notice sounds reasonable, but next again, you should check what the terms of your contract were. I wish you adjectives the best and hope you guys find a better place soon. Take care!

She can't just transmit you to move out. She needs to give you written notice. Check your rental agreement to see how much distinguish she is required to give you. It should also state when she needs to give you the become aware of by before it is carried over into another month.
I'm sorry to hear about that. Your situation really sucks. I am not familiar near California law, however, what your landlord is doing is likely immaculately legal. They are the owners, and are giving you more than 30 days notice. If you do not have a contract which specifies how long you enjoy the apartment for, then they can legally kick you out at anytime for any function. Again, I'm sorry to hear this.
You probably signed a rental agreement. You need to read that. In in attendance somewhere is the requirements to be met for eviction. It most likely says the landlord have to give you 30 days notice as most rental agreements are month to month. If it says the consideration has to be in writing, then you can point that out to the tenant. That will give you one extra month as she will simply give you the notice surrounded by writing next time. Also read the contract as far as deposits. If it says you have to take-home pay "first, last and deposit" then what that means is when you took out the lease you have to pay the first month's rent and the last month's rent and the deposit. If your mother did not pay for June afterwards that is the last month, the landlord get the rent and your mother knows it and has to be out by July first. However, if the contract does not say first, end and deposit and just talks about the first month's rent and deposit, consequently your mother owes rent for June and should pay it. By not paying it, she sets herself up for a legal eviction and she could be forced out of the house as early as the 15th of June. The solely way your mother can stay is if she has a lease for a certain term of time. Let's say the lease is for one year and only 6 months have gone by. Your mother can insist that she get to stay the remaining 6 months. There is not much the landlord can do is you have a lease that extends beyond 1 July. But other than this, your mother have to move out. That is one of the risks of renting on a month to month basis.

What does your lease say? If you don't have a lease then you may own to move. You may have to move anyway assuming again what the lease says. Owners have to hand over so many days notice before they can evict you.
In a month-to-month residence, either party can terminate the lease beside one month notice. Yes you have to pay rent for every month you live in that. If you have a lease for a longer period, the analysis is different.
If your lease is up,she can tell you to move. She does not have to renew your lease for another year. If you are still living there,not paying Junes rent be a big mistake. She now has grounds to evict you for sure. You have to repay the rent is you are living in the apartment. She can sue you for the rent,court costs and late fees for the month of June.

If she owns it, then yes she can tell you to only just leave. However, I think there is some requisite paperwork to have an official eviction. But forcing the owner to do that is only stalling.
