What happens to a child when CPS removes them from their home?

My boyfriends daughter (she's 3) lives in OK with her mother. We live in WI. CPS have investigated her several times and she thinks they are going to take her kids. Someone told my boyfriend if he doesn't get a legal representative now, once the state has custody we won't be able to achieve her. Shouldn't they place her with him automatically? I'm angry and confused. If she's in a bad environment, we shouldn't enjoy to pay thousands of dollars for a lawyer to get custody of her.
Tracey Seth is right. But I want to warn you that CPS is likely to name the CPS in your state to "check up" on you. Be prepared, but don't be afraid. You can try calling Legal Aid to see if they could possibly help with the attorney. It doesn't hurt to ask. Yup. Get her out of that state and into your hand. You two have the right. Otherwise the poor girl will either goto the state of OK in foster strictness or to live with the nearest relative if possible..
Unfortuantely, you will need a lawyer to gain custody once CRS have taken the child from the home. This is going to be even more difficult due to the distance. Your boyfriend will need a lawyer licensed in Oklahoma and he will probably want to go to OK to plead his case in a home court. If there is a joint custody order contained by place, he may be able to avois trouble and expense by taking legal custody before CPS get involved. Csp, generally wants to place a child with relatives after removal from their. If the father doesn't come forward with or without a lawyer , Cps even consider placing them next to their him. One of the first proceedings that CPS goes through is a petition to the court for acting custody and that is usually a six month period to be renewed in another six months. In certainty, if the children have NOT been removed, I would get her past they are, then CPS really has no way to bring back her from her own father.

Once CPS is granted custody, then your boyfriend is basically at their whim and getting her from their custody WILL cost him more contained by the long run. It sucks, but that is the way it is.
