What happens if someone is issued a summons as the respondent for a divorce hearing?
And does nothing about it? What is the process from there?
the person who issued it wins because you defaulted by not showing up.talk to a lawyer
Nothing specially the lawyer may cross examine u. In whom ever favour u supported for the complain then u should discuss for the same. Not worry about just be Fine!!
If they or their lawyer doesnt show up they lose by default. My first husband did not respond and I got the divorce and the settlement was approved by the judge.
It depends on the state. You can file for divorce, then a notice is sent, they have 30 days to respond in most cases. After that you go back and they will set a court date. The notice of the court date is sent out. They can choose to show up or not to argue their side. If they do not show up you are awarded the divorce ex parte, meaning they did not show up, and the judge rules, most times in favor of whatever you asked for if everything seems to be in order, and fair.
Answer:
The person who has requested the divorce will have their lawyer reissue it in a while and if there is still no response, the lawyer will make an appeal to the court for a hearing with no contest. If the respondent doesn't attend the hearing, the judge will basically decide to grant the divorce and will probably agree to the terms laid out in the divorce by the person requesting it (So say it's you and you're husband/wife has filed for divorce and you don't respond or attend, the judge may award him/her any mutual assets and if you have kids together, may agree an amount of maintennance etc).
That's the way it works over here (Ireland) anyway.
