Tip Wages in Pennsylvania: a few questions.?
I'm working at a golf course in Pennsylvania where I get $2.83 per hour to nouns golf bags on carts and send golfers on the course on their appropriate times. Let's assume I gain $10 an hour cash in tips in sooner or later, and assume I worked 5 hours. When all of the scheduled golfers have gone out, at hand is obviously no more possibility of making tips. If my boss wants me to stay an extra hour to do something where I hold a 0% chance of making tips, is it legal for him to pay me $2.83 for that extra hour? $2.83 X 5 + $10 X 5 = $64.15. If I include the extra hour (meaning I will NOT get tips for the extra hour) it would be $66.98. $66.98/6 = $11.16. So with this extra hour, I am still beating minimum wage ($7.15/hour). Although, the "extra hour of work" is an hour of work that he usually pays $7.15 for, because the work is contained by a different department. What do you think? I couldn't find anything specific in the PA labor laws.
Best Answer:
Your overall pay packet for the pay period including tips must be more than minimum wage. He does not have to take-home pay you more than what he has stated ($2.83) unless he asks you to work so many hours that your overall would drop to below miminum wage.
The law does not really address extra work when tips are not on. This would include setup and clean up time for wait staff etc. The law is here: http://www.dli.state.pa.us/landi/CWP/view.asp?A=185&QUESTION_ID=58271
