Can I obtain a restraining order against someone if it is causing mental cruelty to my children and myself?
esp if it is my ex husband and my kids dad!!!!
If he is DOING something to you that can be DOCUMENTED then you need to start filing reports. Once you have a couple of those completed you can take them to a judge with a motion to restrain. Depending on what he's doing to you will decide the outcome. You might end up with an order to restrain him from you, but not your children. ie: He will still have visitation rights. Or, you might end up with supervised visits. But it all depends on what he's doing to you and your children and if it's documented.
You can certainly try.
Well, you should talk to an attorney about that one. You don't say if your ex has visitation rights. If he does, then you need to fight him in court.
you can for 10-14 days until a hearing, then the judge will decide. I causion you that from the outside, you may appear to be the crule one since it takes 2 to offer a differant opinion on what is right.
Answer:
i would go back to family court and have proof of somesort or try to talk to them and tell them he is making this divorce or sepration harder then it has to be for the kids and it is causing them to.... whatever they are doing. and tell them what their dad has been doing at least maybe you could get supervised vititation so it can be not so hard on you and the children. or maybe get them revoked all together but i would do that if it is really really making it hard for the children. if he does not have visitation rights then get proof that he has been comming around and proking you and causing mental anxity for you and the kids and then you could i think get a restraining order against him.
yes yes yes. all you need to do is drum up enough information and cite enough SPECIFIC examples that you can bring to court with you to convince a judge to give you the order. If you have police reports or anytime you involve civil authority, you need to make sure you keep a record of that.
It might be a bit tough, but I think you can do it.
Call your local bar association and explain your problem. They'll point you in the right direction.
Good luck.
You will need solid evidence to support your claim, especially if he has visitation rights.
Oh, I thought you were trying to get an order placed on George Bush.
