What am i entitled to?


I have been living with my manager since november. It has been a pleasent experience up untill last month. On the 25th of June the hose pipes of a flat 3 floors above burst and as the water has passed through the floors it has dripped through to our flat and for days after wet was constantly dripping through making the walls damper. At the time we were told off the building company that we are to be moved out into a hotel for 3 months while they knock down and rebuilt the bathroom. This is not an option i was jolly with especially when the company then told us that we would have to reward for the hotel out of our own pockets for 3 months and we would be reemburshed! (as you could imagine this could potentially cost me thousands).. The situation has taken a turn for the worse over the past few weeks where on earth the walls of the bathroom are completely covered by thick green mould which is a serious health hazard. At the emergence of this month it came time to pay my lb400 rent. I mentioned i was not elated paying the full amount if any at all because the flat is a health hazard and smells disgusting. After audible range that my landlord would be financially short if he didnt recieve the money and he would reimbursh me at a later date.. i transferred the money to keep the situation sweet. Since the emergence of the month the mould has got worse and we are being fobbed stale by the building company and its nearly a month since it happened and we have not been moved all the same. I have only stayed in the house a little times because of the health implications... but it has gotten to the point where on earth yesterday i told my landlord (who has not stayed in the house any and has been staying at his girlfriends) that i was going to move out at the wrap up of the month. I am getting slightly concerned that i am going to get screwed over here... 1. I have paid lb400 to not even stay contained by a flat thats a complete health hazard (so much so that he is not even staying in it) - and i want some of that money subsidise 2. Concerned about not getting my deposit back as i have with the sole purpose give him 2 weeks notice where it say a month in the contract.. (im sick of being promised things that are not happening.. i am not one moved into a hotel... and im not living in that horrible.. smelly.. and health affecting environment any more. I wish to know what you adjectives would do in this situation..and what my rights are.. Cheers

I just went through something similar where on earth a pipe leaked water down the wall. I insisted they replace the sheetrock after removing it and we let the wood dry out for a few weeks until that time patching it all up. At no time did I have to move out in demand to have that done. A wall was still there newly without sheetrock and some insultation. Did they ask any other tenant to move or was it just the 2 of you in that? You can go to court to get your money back but first you hold to use alternative dispute resolution [see linky below]. Search to see if you have a landlord tenant association or law that can minister to. Here in the US we have a laws that force landlords and cities to settle for tenant relocation for major repairs. Does your rental agreement have a "lift and shift" clause? The proprietor may be able to move you into a vacant unit at indistinguishable rate at any other property they own. I would try looking for a relocation law and give a arbitration a try. You have a biddable case but you may just have to move for upright somewhere else.

Move now. Sue for the deposit after the landlord has gotten the house and situation below control. Asking for the deposit back right now will just win a pay you alter response.
