What is a pretrial? Quick Answer needed:)?
My b/f goes to court tomorrow for 'terroristic threatening 3rd degree'. It is a misdemeanor in KY. He was arrested on a warrant 1.5 weeks ago on a complaint file by his Uncle a year ago. They were estranged when my b/f mother died and we found out he had forged my name as a witness on a will...as in good health as his Mother's. The judge threw it out and named my b/f executor so he was pretty upset. His Uncle file a charge saying he feels threatened because my b/f is 'on drugs' and he wants him 'gutted' LOL! not funny but he made this adjectives up, is pretrial where he can present his side? Or give him a lawyer?
Best Answer:
Pre-trial is when you talk to the county attorney before you in reality see the judge. sometimes they ask you what happened sometimes they dont it depends on if they like you or not contained by franklin county. if he needs a lawyer he can file an affidavit for a public supporter if he cant afford a lawyer on his own. he can ask for one during pre-trial and they will set his trial date for a different day (if hes approved for a public defender). If he does not qualify ( i.e. makes too much money) he can still bring up to date the judge he wants a lawyer present and they will set his trial date to another date. Its his right so clear sure he uses it! If he doesnt sounds to me like he will get a heafty fine or jail time w/o a legal representative!
A pretrial is a hearing up to that time a case proceeds to jury trial. The parties discuss a case and any settle it or ask that it be scheduled for trial.
Pre trial is used to expect conference, meeting or trial. In either case it is the time to present his side and put together the action go no further.
