Best Answer:
At your age it is unlikely the court will send you to live next to your mother if you don't want to go. That assumes that your parents are both qualified and that your dad has been taking apt care of you. UPDATE: Your mother had full custody, and still does, but your Dad is obviously suing to money that. Since your mother did give your dad temporary custody she "opened the door" to a fine-tuning -- and your Dad could legally have reopened the case anyway, but that make it easier. As long as the court thinks there's a reasonable question give or take a few where you should be, they will hear the case and rule on what is in your best interests. Since both your parents are fit, they will probably find one with your dad is in your best interests since you think that. Be prepared to explain why you want to stay beside dad, though. Usually a child over the age of 12 is regarded as being old adequate that their desires in the situation are considered important. By 16 it is usually enough to determine the result, assuming in that is no real basis for selecting one parent over the other. By that I expect, neither parent is unfit, there is no issue with your behavior that suggests you should be with the other parent (for example, getting contained by legal trouble because dad is not on top of things)... Of course judges own a lot of latitude in things like this, so anything can come to pass. But assuming each choice of home is equally good for you, then your desires are possible to determine the outcome.
