Help understanding Victim Impact Statement?
I'm going to trial against the man that raped me, and I have to fill out some forms, but I don't understand them. I'll write and explain what I don't understand.
'Do you desire restitution from the defendant?' - I don't understand what 'restitution' means.
'What are your thoughts regarding the sentence the Court should impose on the defendant?' - That sentence I completely don't understand.
Thanks in advance!
1st - what do you want from the raper? do u want money or w/e from him for what he did to u.
2nd - How long in jail or what punishment do you think the raper should have? 5 yrs? 10..15 in jail.. w/e
Do you have a 'Victim's Advocate' to help or perhaps someone at the Prosecutor's Office? I'd try there first...
1. Restitution usually means monetary. Did your clothes get ripped, did you miss work, did you have to get counseling. These might have a cost involved and for which you could seek restitution. He can't return your feelings of safety, trust...
2. What punishment, what amount of time, do you want the Defendant to serve. Where do you want the Defendant to serve the time, county jail, prison.Do you want him to rot in hell, to be forgiven...
But ask the VA or PO. Good Luck
I just have to say that TXofficer got it exactly right...
My '2 cents worth' here was just to say how proud everyone should be of you...how brave you are, and how much you are admired for taking a stand...
Talk with your court advocate or call the DA's office if you need further help or have questions...
You will do wonderfully, I'm sure...Women everywhere are standing and applauding your courage!
You go girl!
restitution can come in the form of money. or do you want him to pay in other ways. what type of sentence would you like him to get... one yr in prison.. twenty or life. that kind of thing. or would you prefer.. he not go to prison. ..remember rapist usually do it again...
Answer:
Restitution is a repayment or compensation that is paid from the defendent (rapist) to the plaintiff (you). I imagine that you can ask for monetary compensation, or simply an apology.
As for the 2nd question, it is asking for your thoughts on what the rapist's sentence should be (amount of jail time, probation, et cetera).
I applaud you for taking a stand against your attacker. You are strong and you will do an awesome job in court.
Jimmy, so sorry to hear about your situation, over time things will get better. 'Restitution' means, do you want money from the fool. You may have had medical bills etc that you had to pay for. He should pay for any expense that you incurred.
The second part means what do you feel should happen to this guy. Do you think he should go to jail , etc.
If you are still confused, call the prosecutor and ask him to explain these issues to you.
