Is Bush not disgracing the US flag by letting it fly over Guantanamo?

I posted this on the US site, what do the Brits think?

I believe that all territory under a flag flying in similar circumstances MUST come under the laws of the flag's nation, in other words forbidding maltreatment of individuals such as has been happening for years!
I think Guantanamo is a classic example of Bush's hypocritical foreign policies.

I think some Americans are wise enough to realise that no-one asked their nation to be the world police and that they aren't cut out for the job anyway. People have been left rotting in Guantanamo for a number of years, sometimes with no proper legal process and no human rights whatsoever. It is not really right to invade a country, take people hostage, and then torture them because you think they might be a threat (but you're not sure).

What good has America done in the middle East? How many innocent people have died there? For how long will he be allowed to continue these human rights violations?

I do agree that the US (and, to some extent the UK) are under the threat of terrorism, but how is G'amo helping diffuse the situation? What kind of example is it setting to the rest of the world?

I realise I am answering this question with more questions - but maybe I am not qualified to answer, or maybe there is a hint of rhetoric...

One last question, why are Guantanamo's prisoners not being held on US soil?

Example: Some of the terrorists there went on hunger strikes, Since American medical ethics have to save lives they put the guys on FEEDING TUBES. How is that torture keeping the scum of the earth alive, WHEN THE SCUM WANT TO DIE. Stop with this bleeding heart liberal crap you coward. STOP LOVING TERRORISTS.


Answers:
It is under our laws. The prisoners held their are enemy combatants and we're not severely torturing them. We're being relatively nice.
If the 'enemy combatants' have charges to answer they should have a fair trial. Also information obtained under duress is without value.

Guantanamo is not an 'anomaly' it is an abuse of often innocent human beings. Bring back Omar!
