Need legal advice - How can I legally do this thing?


Some other fans of the original KING KONG, being displeased near Peter Jackson's film, want to write our own interpretations of KONG in screenplay form. I am asking this question to relieve with MY project. Now, there is the public domain novel, which is flawless, but there are some things in the original show that as a fan I love, and the novel does not have. So my put somebody through the mill is this: How much can I use from the original film so my screenplay can be seen as a derivative work of the untested and therefore legal? Should I still write the Merian C. Cooper estate to get blessing, or will it pass under fanfiction, spoof, or another form of derivative work? Peter Jackson got no rights except for the loophole of the new-fangled being there, and the loophole of homage. I want to do the same, but I inevitability advice on which loopholes/tricks/courses to take in this project of mine - HELP!!! That info on Chilling Effects, I own read it before, but I still do not comprehend. Is anyone here a lawyer or something? Do you know for certain if I am contained by the right or in the wrong?
